Tasty Rewards Super Bowl Experience Sweepstakes (“Sweepstakes”)

Official Rules (the “Rules”)

THE FOLLOWING PROMOTION IS INTENDED FOR PARTICIPATION IN THE UNITED STATES ONLY AND WILL BE GOVERNED BY U.S. LAW. DO NOT ENTER UNLESS YOU ARE AT LEAST 21 YEARS OF AGE IN YOUR STATE OF RESIDENCE LOCATED IN THE UNITED STATES AND A TASTY REWARDS MEMBER AT THE TIME OF ENTRY. 

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING. VOID WHERE PROHIBITED BY LAW. BY PARTICIPATING IN THIS SWEEPSTAKES, ENTRANT AGREES TO BE BOUND BY THESE OFFICIAL RULES AND THE DECISIONS OF THE JUDGES, WHICH SHALL BE FINAL IN ALL RESPECTS. AN ENTRANT IS NOT A WINNER OF THE PRIZE, EVEN IF THE SWEEPSTAKES SHOULD SO INDICATE, UNLESS AND UNTIL ENTRANT’S ELIGIBILITY AND COMPLIANCE WITH THE RULES HAVE BEEN VERIFIED AND ENTRANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE.

1. ELIGIBILITY: This Sweepstakes is open only to individuals who are legal U.S. residents of one of the 50 United States or the District of Columbia and 21 years of age or older at the time of Entry, AND a Tasty Rewards member and have a valid US driver’s license or government issued photo ID. The following persons are not eligible to participate: Employees, contractors, directors and officers of Pepsi-Cola Company, Frito-Lay, Inc. (“Sponsor”), each of their parent, subsidiary and affiliated companies, distributors, Web design, advertising, fulfillment, judging and promotion agencies involved in the administration, development, fulfillment and execution of this Sweepstakes (collectively, “Sweepstakes Parties”), including its affiliates and agents, and their respective immediate family members (spouse, parent, child, sibling, grandparent, and/or “step”) of each and those living in their same households (those persons whether related or not who live in the same residence for at least three months during the twelve-month period preceding the start date of the Sweepstakes). 

Employees, officers, directors, agents and representatives of the NFL Enterprises LLC (hereafter, “Sponsor”), the NFL Parties (defined as NFL Properties LLC, National Football League, its member professional football clubs, NFL Ventures, Inc., NFL Ventures, L.P., NFL Enterprises LLC, NFL International LLC, NFL Productions LLC, and each of their respective affiliates, owners, subsidiaries, shareholders, officers, directors, agents, representatives and employees, both individually and collectively) and each of their respective parents, affiliates, subsidiaries, advertising and promotion agencies (hereafter collectively, “Released Parties”), and each such individual’s immediate family members (mother, father, sister, brother, any child, husband, wife and their respective spouses, regardless of where they reside) and those living in their same households, whether or not related, are not eligible to participate or win a prize.

2. SWEEPSTAKES PERIOD: Sweepstakes begins at 9:00:00 AM Eastern Time (“ET”) on December 25, 2023 at 12:00 PM (noon) Eastern Time (“ET”) and ends at 11:59:59 PM ET on January 21, 2024 (“Sweepstakes Period”). The time clock of computer administering this Sweepstakes is the official clock for this Sweepstakes.

3. HOW TO ENTER: During the Sweepstakes Period, an eligible Tasty Rewards entrant will be able to access the Sweepstakes through their homepage and account (“Account”) dropdown on tastyrewards.com (“Website”). Upon signing into their Tasty Rewards Account an eligible entrant may collect entries by completing one or more of the activities (each an “Activity”) as indicated in their “My Activities” page.  Upon completing an Activity, entrants will receive the applicable number of entries as set forth in the “My Activities” page (“Entries” or “Entry Points”). All entrants must have a valid email address. 

Entrants may use or bank Entries or Entry Points.  During the Sweepstakes Period, Entrants may choose to use one or more of their collected Entries or Entry Points into the Tasty Rewards Super Bowl Experience Sweepstakes random prize drawing (defined in Section 4) for a chance to win the prize defined in Section 5 below or bank Entries or Entry Points and save them to use at a later time. If you do not wish to use Entries to enter this Sweepstakes drawing, Entries or Entry Points will remain in your Account until you choose to enter another Tasty Rewards promotion drawing or until Entries or Entry Points expire.  Unused Entries or Entry Points will expire after 12 months of no activity in your Account or 12 months following the date on which you completed an Activity, earned an Entry, but did not use it for a particular drawing (any unused Entries remaining in an Account after that time will be forfeited).  Entries or Entry Points have no cash value, may not be transferred to a third party and may not be aggregated from multiple Accounts. Unexpired Entries collected and not used for this Sweepstakes may be eligible for future Tasty Rewards drawings, in Sponsor’s sole discretion.  Any Entries used in this Sweepstakes drawing will not carry-over into other Tasty Rewards promotion drawings and will be void. By submitting an entry into this Sweepstakes drawing, you confirm that you are eligible to participate according to these Rules.  When logged onto your Account you can check your Account details for Entries or Entry Point balances and details. The decisions of the Sponsor with respect to Sweepstakes entry, Account balances and transactions are final and binding and non-appealable in all respects. Proof of submission will not be deemed to be proof of receipt by Sponsor.  No mechanically reproduced, altered or forged entries are permitted.

Each submission must be manually key stroked and/or manually entered by the individual entrant; automated and/or repetitive electronic submission of entries (including but not limited to entries made using any script, macro, bot or sweepstakes service) will be disqualified and transmissions from these or related email addresses/IP addresses may be blocked. Additionally, use of multiple email addresses, phone numbers and/or mailing addresses, and/or the manipulation of such information, for the purpose of obtaining more than the stated number of Entry Points, Sweepstakes entries, and/or prizes, is prohibited and such persons will be disqualified and all Entry Points or Sweepstakes entries shall be deemed invalid and any prize won shall be forfeited, as determined in the sole discretion by the Sponsor.  

4. PRIZE DRAWINGS: On or about January 22, 2024, Sponsor’s representatives, whose decisions are final and binding on all matters relating to this Sweepstakes, will randomly select three (3) prize winners for the prize indicated below from all eligible Sweepstakes entries received during the Sweepstakes Period.  Odds of winning a prize depend on the number of eligible Sweepstakes entries received during the Sweepstakes Period for the Sweepstakes drawing.

5. PRIZE DETAILS: THREE (3) PRIZE WINNERS WILL BE RANDOMLY CHOSEN: The “Prize” or “Trip Prize” is a trip for each winner and their one guest (who must be 21 or older) to Paradise/Las Vegas Valley, Nevada for Super Bowl LVIII scheduled to take place on February 11, 2024 (the “Event”).  

Trip Prize includes two (2) tickets to the Event, all details determined by Sponsor in its sole discretion; round trip, coach-class air transportation for winner and one (1) guest via a Sponsor-selected air carrier(s) from a major commercial airport selected by Sponsor in its sole and absolute discretion to a major airport near the destination city; three (3) nights’ accommodations (private bedroom in a house room, double occupancy) (February 9-12, 2024); round trip ground transportation between airport and accommodations, and between accommodations and the event; dinner with a notable NFL personality (chosen at Sponsor’s sole discretion) and other prize winners, select NFL merchandise, two tickets to a Cirque du Soleil show of Sponsor’s choosing, and certain food and drink. See additional details and disclosures below. All NFL tickets are subject to certain terms and conditions as specified thereon, including the requirement that winner must download a mobile ticket app (valid email address required) and present tickets at stadium via a mobile device. Message and data rates may apply. Additional prize award details and travel information to be provided to the winner at the time of Trip Prize notification.  

Approximate Retail Value (“ARV”) of each Trip Prize is $24,562.50. Total Approximate Retail Value (“ARV”) is $73,687.50.

Special Notes for winner and guest: Must complete a release of liability form and photo, video, and likeness release form. No drug use or firearms permitted. No hateful or violent behavior. Winner and guest are responsible for maintaining the condition of any items provided during the Event or prize experience and returning them in the same condition upon completion of the prize experience.

The actual value of the Trip Prize may vary depending on point of departure, booking dates and fare/rate fluctuations.  If the actual value of the prize is less than the stated ARV, the difference will not be awarded.  All travel arrangements must be made through the Sponsor or Sponsor’s designee.  Certain restrictions may apply. The dates of departure and return are subject to change at Sponsor’s sole and absolute discretion. Sponsor shall not be responsible for any cancellations, delays, diversions or substitution or any act or omissions whatsoever by the air carriers, accommodations provider, venue operators, transportation companies, prize providers or any other persons providing any Trip Prize-related services or accommodations.   Sponsor reserves the right to structure travel route and select accommodations in their sole and absolute discretion. The round trip air transportation element for the Trip Prize begins and ends at the point of departure. The Trip Prize is subject to seat and accommodations availability, as well as Sponsor’s terms and conditions generally applicable thereto. If, in the judgment of Sponsor, air travel is not required due to winner’s proximity to Trip Prize location, ground transportation will be substituted for round trip air travel at Sponsor’s sole and absolute discretion.  All aspects of the travel portions of the Trip Prize must be conducted on such dates as determined by Sponsor in its sole and absolute discretion, surrounding the Event. The winner of the Trip Prize must travel as and when designated by Sponsor or the Trip Prize may be forfeited and an alternate randomly selected winner chosen, if time permits. No refund or compensation will be made in the event of the cancellation or delay of any transportation or missed prize events, opportunities or expenses incurred or change to any other prize element as a consequence of delay or cancellation, except at the sole and absolute discretion of Sponsor.    

The winner and winner’s travel companion must travel together and on the same itinerary and possess all required travel documents, including visas and valid passports, if and as applicable.  It is the responsibility of the winner and winner’s companion to provide proper documentation (including government issued picture identification). Winner and companion are responsible for obtaining travel insurance (and all other forms of insurance) at their option and hereby acknowledge that Sponsor has not and will not obtain or provide travel insurance or any other form of insurance.  The winner will be required to provide a credit card at the time of check-in.  Airline tickets are non-refundable/non-transferable and are not valid for upgrades and/or frequent flyer miles. All travel must be completed before February 12, 2024, or prize will be forfeited. 

Winner’s travel companion must be at least 21 years of age as of the date of departure. Winner’s travel companion must execute liability/publicity releases prior to issuance of travel documents.  Once a travel companion is selected, such companion may not be substituted, except in Sponsor’s sole and absolute discretion.  Travel is subject to the terms and conditions set forth in this Sweepstakes, and those set forth by Sponsor’s transportation carrier(s) of choice.  Lost, stolen or damaged airline tickets, travel vouchers or certificates will not be replaced or exchanged.  All expenses not specifically mentioned herein, are not included as part of any Trip Prize package, and are solely the winner’s responsibility, including, but not limited to: excursions, taxes, additional ground transportation at the winner’s destination(s), travel insurance, room service, bag check fees, parking fees, laundry service, food, alcoholic beverages, merchandise, souvenirs, telephone calls, tips, gratuities and service charges. Transportation carrier and regulations and conditions of the accommodations provider apply.  Travel and lodging are subject to availability, and any changes made to either of these will be at the expense of the winner.

If, for whatever reason, the Event associated with the prize is cancelled after the prize is awarded, Sponsor’s liability for the prize is limited only to the non-Event portions of the prize.  No compensation will be paid in lieu of the cancelled Event.  The tickets to the Event are subject in all respect to the terms and conditions set forth on the tickets and any requirements of the facility hosting the Event.  Seat locations will be determined by Sponsor.  The winner is strictly prohibited from selling, auctioning, trading or otherwise transferring the tickets unless Sponsor consents in writing.  In the event winner (and/or companion) violates any venue or NFL policy or law, fails to comply with the NFL’s (or its designee’s) health and safety protocols, brings the Sponsor, Sweepstakes Parties or the Released Parties into disrepute, or engages in behavior that (as determined by Sponsor, the NFL Entities, or any prize provider in its or their sole and absolute discretion) is obnoxious, inappropriate, safety risk, or threatening, illegal or that is intended to annoy, abuse, threaten or harass any other person, Sponsor reserves the right to revoke the full or partial prize from any winner or guest or terminate the applicable experience early.  Decisions regarding the conduct of the winner and guest in all aspects of their participation in the prize Event/activity will be in the sole discretion of Sponsor, and any of Sponsor’s representatives and final and binding in all respects.  Winner and guest may be removed or disqualified from participating in any aspect of the prize for any reason at any time, including, without limitation, creating an unauthorized disturbance, interruption or unnecessarily rough physical contact, creating the potential for injury or property damages, or for any unhealthy, unsafe, unlawful, or inappropriate act.  If winner or guest, in the opinion of Sponsor or any of Sponsor’s representatives, is considered a physical or mental threat to the well-being of any other individual, he/she may be removed from any premises relating to the prize and winner consents to such removal. For the avoidance of doubt, unused tickets cannot be refunded, exchanged or applied towards tickets for any subsequent NFL event or for cash.

6. LIMITATIONS OF LIABILITY AND RELEASE: No liability or responsibility is assumed by Sponsor, Sweepstakes Parties, or Released Parties resulting from entrant's participation in or attempt to participate in the Sweepstakes or ability or inability to upload or download any information in connection with the Sweepstakes. No responsibility or liability is assumed by the Sponsor, the Sweepstakes Parties, or Released Parties for technical problems or technical malfunction arising in connection with any of the following occurrences which may affect the operation of the Sweepstakes: Hardware or software errors; faulty computer, telephone, cable, satellite, network, electronic or Internet connectivity or other online or network communication problems; errors or limitations of any Internet providers, servers, hosts or other providers; garbled, jumbled or faulty data transmissions; failure of any online transmissions to be sent or received; lost, late, delayed or intercepted transmissions; inaccessibility of the Web Site in whole or in part for any reason; traffic congestion on the Internet or Web Site; unauthorized human or non-human intervention of the operation of the Sweepstakes, including without limitation, unauthorized tampering, hacking, theft, virus, bugs, or worms; or destruction of any aspect of the Sweepstakes, or loss, miscount, misdirection, inaccessibility or unavailability of an email account used in connection with the Sweepstakes. Sponsor is not responsible for any typographical errors in the announcement of prizes or these Rules, or any inaccurate or incorrect data contained on the Web Site. Use of Web Site is at user’s own risk. None of the Sponsor, Sweepstakes Parties, or Released Parties are responsible for any personal injury or property damage or losses of any kind which may be sustained to user's or any other person's computer equipment resulting from participation in the Sweepstakes. In the event of an identity dispute, Entry will be considered made by the registered owner of the email address associated with the account used for Entry. “Registered owner” is defined as the natural person who is assigned an email address by an Internet access provider, online service provider or other organization which is responsible for assigning email addresses or the domain associated with the submitted email address. The entrants and winners acknowledge that neither the Sweepstakes Parties or the Released Parties have made nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to any prize, including but not limited to its quality, mechanical condition or fitness for a particular purpose.  Any and all warranties and/or guarantees on a prize (if any) are subject to the respective manufacturers’ terms therefore, and winners agree to look solely to such manufacturers for any such warranty and/or guarantee.  SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL, CONSEQUENTIAL, OR OTHER DAMAGES; AS A RESULT, THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU, AND THE FOREGOING PARAGRAPHS SHALL NOT APPLY TO A RESIDENT OF NEW JERSEY TO THE EXTENT DAMAGES TO SUCH NEW JERSEY RESIDENT ARE THE RESULT OF SPONSOR OR PROMOTION PARTIES’ NEGLIGENT, FRAUDULENT OR RECKLESS ACT(S) OR INTENTIONAL MISCONDUCT.

7. WINNER NOTIFICATION: Potential winners will be contacted by email and will be required to follow instructions within the notification within forty-eight (48) hours (beginning at the time the notification was sent), or prize may be forfeited, in Sponsor’s sole discretion. If no return message is received within the time allotted, an alternate winner will be selected, time permitting. Any alternate Prize winners selected will also be required to respond to the prize winning message within 48 hours.  The Potential winners will be required to complete, sign and return an Affidavit of Eligibility/Liability Release, and, where lawful, Publicity Release within two (2) days of prize notification. Prize winners’ guests must complete and return a Liability/Travel Release within the same time period. Failure to return the Affidavit within the specified time period may result in prize forfeiture, in Sponsor’s sole discretion, and an alternate Prize winner may be selected.

Sponsor will attempt to notify each potential winner as set forth above, but Sponsor is not responsible for any change in entrant's email address, mailing address and/or telephone number. If attempted notification is returned as undeliverable (including without limitation e-mails that are not received because of a winner’s privacy or spam filter settings which may divert any Sweepstakes e-mail, including any winner notification e-mail, to a spam or junk folder), if any required documents are not returned within the required number of days, if winner cannot be verified, or if winner is otherwise unable to accept the prize as stated, prize may be forfeited. If a prize is returned as undeliverable, the prize may be forfeited and Sponsor shall have no further liability to award that prize.

8. RELEASE OF LIABILITY: By participating in the Sweepstakes, entrants agree (a) to release Sponsor and Sweepstakes Parties, and each of their respective parent companies, subsidiaries, affiliates, officers, directors, employees, governors, owners, distributors, retailers, agents, assignees, advertising/promotion agencies, representatives, and agents (“Released Parties”) from any and all claims, damages or liabilities arising from or relating to such entrant's participation in the Sweepstakes; (b) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses and all participants hereby further waive all rights to have damages multiplied or increased; (c) all causes of action arising out of or connected with this Sweepstakes, or any prize awarded, shall be resolved individually, without resort to any form of class action; and (d) any and all claims, judgments, and award shall be limited to actual out-of-pocket costs incurred, excluding attorneys’ fees and court costs. By accepting a prize, recipients (a) agree that Released Parties will have no liability whatsoever for, and shall be held harmless by winner against, any liability for injuries, losses or damages of any kind to persons or property resulting in whole or in part, directly or indirectly, from participation in the Sweepstakes; from acceptance, possession, misuse or use of any prize, including travel thereto and (b) grant (and agree to confirm grant in writing promptly upon request) to Sponsor and its designees and assigns the right to use his/her name, photograph, likeness, voice, image, statements, biographical information at any time or times, for advertising, trade, publicity and promotional purposes in any media now known or hereafter discovered, worldwide, including the Internet without review, notification or approval, and additional compensation or consideration, unless prohibited by law. Released Parties are not liable in the event that any portion of the Sweepstakes (including any prize) is canceled due to pandemics or epidemics, outbreaks of infectious disease or any other public health crisis including quarantine measures of any government authority or other restrictions, weather, fire, strike, acts of war or terrorism, or any other condition beyond their control (a “Force Majeure Event”). 

Participant irrevocably waives all claims against the National Football League, its member professional football clubs, NFL Ventures, Inc., NFL Ventures, L.P., NFL Properties LLC, NFL Enterprises LLC and each of their respective subsidiaries, affiliates, shareholders, officers, directors, agents, representatives and employees (collectively, the “NFL Entities”) and agrees that the NFL Entities will have no liability or responsibility for any claim arising in connection with participation in this Sweepstakes or the prizes awarded. The NFL Entities have not offered or sponsored this Sweepstakes in any way.

9. GENERAL CONDITIONS/DISPUTE RESOLUTION: Winners are solely responsible for any and all federal, state and/or local taxes, and for any other fees or costs associated with the prize they receive, regardless of whether it, in whole or in part, are used and will receive an IRS Form 1099. No substitution of prize is offered, except at the sole discretion of the Sponsor. No transfer of prize is permitted. If a prize, or any portion thereof, cannot be awarded for any reason, Sponsor reserves the right to substitute prize with another prize of equal or greater value. Unclaimed prizes will not be awarded. If for any reason the Sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes, Sponsor reserves the right, at its sole discretion, to (a) disqualify any individual who is responsible or who tampers with the Entry process, and (b) cancel, terminate, suspend, postpone, delay or modify the Sweepstakes in whole or in part, including without limitation, any means of Entry or redemption, at any time, including but not limited to, any occurrences described in Section 6 above, or any other causes which may corrupt or impair the integrity, security, fairness or proper conduct of the Sweepstakes, or if Sponsors determine that more prize claims are submitted and/or more prize notices are distributed than the number of prizes offered in these Rules. In such event, Sponsors shall immediately suspend all drawings and prize awards, and Sponsors reserve the right to randomly award any remaining prizes (up to the total set forth in these Rules) in a manner deemed fair and equitable by Sponsors, such as by way of example and not by way of limitation, in a random drawing from among the eligible Entries received up to the time of the impairment, and Sponsors and Sweepstakes Parties shall not have any further liability to any participant in connection with the Sweepstakes. Sponsors may modify and amend these Rules as they appear online from time to time during the Sweepstakes for clarification purposes without materially affecting the terms and conditions of the Sweepstakes. The parties waive all rights to trial in any action or proceeding instituted in connection with these Rules, including, without limitation, the Sweepstakes. The parties each agree to finally settle all disputes only through arbitration; provided, however, the Sponsor shall be entitled to seek injunctive or equitable relief in the state and federal courts in Texas, and any other court with jurisdiction over the parties.  In arbitration, there is no judge or jury and review is limited.  The arbitrator’s decision and award is final and binding, with limited exceptions, and judgment on the award may be entered in any court with jurisdiction.  The parties agree that, except as set forth above, any claim, suit, action or proceeding arising out of or relating to this Contest shall be resolved solely by binding arbitration before a sole arbitrator under the streamlined Arbitration Rules Procedures of JAMS Inc. (“JAMS”) or any successor to JAMS.  In the event JAMS is unwilling or unable to set a hearing date within fourteen (14) days of the filing of a “Demand for Arbitration”, then either party can elect to have the arbitration administered by the American Arbitration Association (“AAA”) or any other mutually agreeable arbitration administration service.  If an in-person hearing is required, then it will take place in Texas. The federal or state law that applies to these Official Rules will also apply during the arbitration.  Disputes will be arbitrated only on an individual basis and will not be consolidated with any other proceedings that involve any claims or controversy of another party, including any class actions; provided, however, if for any reason any court or arbitrator holds that this restriction is unconscionable or unenforceable, then the agreement to arbitrate doesn’t apply and the dispute must be brought in a court of competent jurisdiction in Texas.  Sponsor agrees to pay the administrative and arbitrator’s fees in order to conduct the arbitration (but specifically excluding any travel or other costs of entrant to attend the arbitration hearing).  Either party may, notwithstanding this provision, bring qualifying claims in small claims court.  This Sweepstakes is offered only in the United States and is governed by the laws of the state of Texas, and all claims must be resolved in the federal or state courts located in Collin or Dallas counties, Texas. For purposes of the Sweepstakes, an entrant’s residential address and e-mail address will be the physical address and e-mail address submitted at the time of Entry. Entrants will not be allowed to change their physical address or e-mail address. If it is discovered or suspected that an entrant has registered or attempted to register for the Sweepstakes using multiple e-mail addresses or multiple identities, all of that entrant’s Entries (as defined above) or Sweepstakes entries associated with that household (determined by Sponsor and/or its administrator in its sole discretion) may be disqualified and any prize an entrant might have been entitled to win will not be awarded any may be revoked. Use of any automated system or any like methods to participate in the Sweepstakes is prohibited and will result in disqualification of any entrant attempting such use.

10.  ENTRY INFORMATION AND CONTEST COMMUNICATIONS: As a condition of entering the Sweepstakes, each entrant gives consent for Sponsor to obtain and deliver his or her name, address and other information to third parties for the purpose of administering this Sweepstakes and to comply with applicable laws, regulations and rules.  Any information entrant provides to Sponsor may be used to communicate with entrant in relation to this Sweepstakes or on a Sweepstakes Winner’s list. By participating in the Sweepstakes, participant agrees to all of the terms and conditions of the Sponsor’s Privacy Policy, which is available at https://contact.pepsico.com/FritoLay/privacy-policy.
